Welcome to BabySync ("the Application"), operated by alkashier ("Company", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the BabySync mobile application and any related services provided by alkashier.

By downloading, accessing, or using BabySync, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Application.

1. Target Audience and Eligibility

BabySync is designed strictly for use by adult parents, legal guardians, and adult caregivers (aged 18 and older) of newborns and infants. The Application is intended to be operated by adults only, not by children. By using BabySync, you represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into these Terms.

2. User Accounts and Data Privacy

Account Creation: BabySync utilizes Firebase Authentication for anonymous sign-in. We do not collect, request, or store personal identifiers such as your email address or password to create or maintain your account.

Data Storage: The Application utilizes Cloud Firestore to store limited operational data provided by you, including the baby's first name, parent/caregiver display titles (e.g., "Mom", "Dad"), and care logs (such as feeding, diaper change, and sleep timestamps).

Data Deletion: You retain ownership of your data. You may request the permanent deletion of your stored data at any time by contacting us at our support page (https://smartlinks.live/app/babysync/support).

3. Third-Party Services and Advertising

BabySync integrates third-party services to enhance function, analytics, and advertising operations. By using the Application, you acknowledge and accept the privacy policies and practices of these third-party services:

• Firebase Authentication & Cloud Firestore: Provided by Google LLC for user authentication and data management.
• Google AdMob: Serves banner advertisements within the app and may collect/use advertising identifiers (Advertising ID).
• SmartLinks SDK: Utilized for app analytics events, deep linking, and purchase verification.

4. In-App Purchases and Billing

BabySync offers an optional, non-consumable, one-time in-app purchase ($3.99 USD or equivalent in local currency) to unlock PDF data export features ("PDF Export Unlock").

• Billing: Payment will be charged to your Apple App Store or Google Play Store account at confirmation of purchase.
• Finality of Purchases: All purchases are final and non-refundable, except as expressly provided by applicable law or the terms of the respective app store platform (Apple Store Terms or Google Play Terms).

5. Medical and Parent Disclaimer

BabySync is a tracking and organizational tool provided solely for informational and convenience purposes. BabySync is not a medical device, nor does it provide medical advice, diagnosis, or treatment. Information logged in the Application should never replace professional medical judgment or advice from qualified healthcare providers. Always consult a pediatrician or medical professional regarding any health concerns about an infant.

6. Intellectual Property Rights

The Application, including its original content, design, code, graphics, branding, trademarks, and features, is and shall remain the exclusive property of alkashier and its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes in accordance with these Terms.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Decompiling, reverse engineering, disassembling, or attempting to derive the source code of the Application;
• Using the Application for any unlawful purpose or in violation of local, state, national, or international laws;
• Interfering with, disrupting, or attempting to compromise the security or integrity of the Application or associated servers/networks;
• Automating access to or scraping data from the Application without express written permission from alkashier;
• Submitting false, deceptive, or malicious data through the Application.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall alkashier, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Application;
• Any conduct or content of any third party within the Application;
• Unauthorized access, use, or alteration of your transmissions or data;
• Any inaccuracies or errors in care tracking records or data exports.

9. Disclaimer of Warranties

The Application is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

10. Dispute Resolution and Governing Law

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which alkashier operates, without regard to its conflict of law principles.

Informal Resolution: In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Application, you agree to first contact alkashier at our support page (https://smartlinks.live/app/babysync/support) and attempt to resolve the dispute informally.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the Application after any such changes constitutes your acceptance of the new Terms.
