Welcome to InspectNest ("App", "Service"). These Terms and Conditions ("Terms") govern your access to and use of the InspectNest mobile application operated by alkashier ("Company", "we", "us", or "our").

By downloading, accessing, or using InspectNest, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. User Accounts and Data Privacy

InspectNest does not require a mandatory user account registration to access core functionalities. All core inspection data, notes, and photos ("Evidence") captured or generated within the App remain stored locally on your device.

• Data Control: Your inspection data is not automatically uploaded to our servers. Data transmission only occurs when you explicitly initiate a report export, backup, or sharing function.
• Device Permissions: The App requests permission to access your device’s camera and photo library solely for the purpose of capturing and attaching inspection evidence. We do not access, scan, or harvest your photo library outside of explicit user actions within the App.
• Responsibility for Data: You are solely responsible for maintaining backup copies of your inspection data. The Company is not liable for data loss resulting from device loss, damage, uninstallation, or operating system updates.

2. Third-Party Advertising and Premium Features

The Service is provided free of charge supported by third-party advertising. Advertisements are served by Google AdMob and its partners.

• Third-Party Content: The Company is not responsible for the content of third-party advertisements, nor for any products, services, or websites offered or obtained through them. Interaction with third-party advertisers is solely between you and the advertiser.
• Optional Premium Upgrades: InspectNest offers optional premium features ("Premium") purchasable via in-app purchases. Premium subscriptions or one-time purchases remove third-party advertisements and lift usage limits. Payments are processed through the respective app store platform (e.g., Apple App Store, Google Play Store), and are subject to their respective terms and billing policies.

3. Intellectual Property Rights

The App, including its original code, design, interface elements, software, brand name, logo, and documentation, is owned by alkashier and is protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use InspectNest for your personal or internal business inspection purposes.

4. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Reverse engineering, decompiling, disassembling, or attempting to derive the source code of the App.
• Modifying, distributing, selling, licensing, or creating derivative works based on the App.
• Using the App for any illegal purpose or in violation of any local, state, national, or international law.
• Attempting to interfere with the proper working of the App or circumvent any security or technical measures.

5. Disclaimer of Warranties ("As Is")

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

No Legal or Professional Advice: InspectNest is an inspection documentation tool only. The App does not provide legal advice, property management advice, or statutory compliance guarantees. The Company does not guarantee tenancy deposit outcomes, legal disputes, property repair claims, or official compliance evaluations. Users should consult qualified legal or professional advisors regarding lease agreements, tenancy rights, or property disputes.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALKASHIER, ITS AFFILIATES, OFFICERS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF DEPOSIT, PROPERTY DAMAGE, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.

7. Multi-Language Support

The App user interface is translated into multiple languages (including English, Chinese, Hindi, Spanish, French, Arabic, Bengali, Portuguese, Russian, and Indonesian) for user convenience. In the event of any conflict, discrepancy, or ambiguity between translated versions of these Terms and the English version, the English language version shall prevail.

8. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which alkashier operates, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall first be attempted to be resolved through informal negotiations. If informal resolution fails, disputes shall be submitted to binding arbitration or the appropriate courts of competent jurisdiction.

9. Changes to Terms

We reserve the right to update or modify these Terms at any time. Updated Terms will be effective upon posting within the App or on our official website. Your continued use of the App following any modifications constitutes acceptance of the revised Terms.
